Are Psychedelic Drugs Legal in Las Vegas?

psilocybin found in magic mushroom is prohibited in Las Vegas, Nevada

Las Vegas is famous for its wild and free spirit, but does that permissive attitude extend to psychedelics? Here’s what you need to know if you’re thinking of taking a trip that goes beyond sightseeing in Sin City.

What Is Considered a Psychedelic Drug?

Psychedelic drugs are substances that alter perception, mood, and various cognitive processes. These drugs often lead to experiences that are significantly different from the normal state of consciousness. Common examples of psychedelic drugs include lysergic acid diethylamide (LSD), psilocybin (found in magic mushrooms), 3,4-methylenedioxymethamphetamine (MDMA or “ecstasy”), and N,N-dimethyltryptamine (DMT), which is present in ayahuasca. People use these substances for a variety of reasons, including spiritual experiences, psychological exploration, and recreation. The effects of these drugs can vary widely based on the type, dosage, and the user’s reaction.

Can You Be Arrested for Using Psychedelics in Nevada Right Now?

Yes, you can be arrested for using psychedelics in Nevada. In Nevada, most psychedelic drugs, including LSD, psilocybin aka psychedelic mushrooms, and MDMA, are classified as Schedule I substances under both state and federal laws. This classification means these drugs are legally considered to have a high potential for abuse and no accepted medical use, making their possession, sale, and use illegal. This remains the case even though ongoing research indicates that psychedelics like hallucinogenic mushrooms and other drugs might have potential medical and mental health benefits.

If law enforcement catches you with these drugs, you face the risk of arrest and charges punishable by fines and imprisonment. Therefore, it’s important to be aware that, despite changing attitudes towards some drugs, the use of psychedelics remains illegal in Nevada.

What Is Nevada Senate Bill 242?

Originally, Nevada Senate Bill 242 was a legislative proposal that aimed to change how the state handled certain drug offenses involving psychedelics. The bill initially proposed decriminalizing the possession of less than four ounces of psilocybin-containing mushrooms for adults. However, SB 242 underwent significant changes during the legislative process.

The final version of the bill, which passed and became effective on June 12, 2023, established the Psychedelic Medicines Working Group (PMWG) by the Nevada Department of Health and Human Services. This group is tasked with studying the medical uses of psychedelic drugs. However, SB 242 did not alter how Nevada law currently categorizes most psychedelic substances or handles drug-related offenses involving psychedelics.
